Terms of Service

Please note: QualDashboard is a platform that lets academies sell their own courses to their own learners. Each academy is the seller of its courses and is responsible for its course content, pricing, delivery, any accreditation claims, and its own refunds. QualDashboard provides the technology and takes a per-order fee; it is not the seller of academy courses.
1. Who we are & these terms
The Services are provided by [COMPANY NAME] (Company No. [COMPANY NUMBER]), a company registered in England and Wales with its registered office at [REGISTERED ADDRESS], trading as QualDashboard (“QualDashboard”, “we”, “us”). By creating an account, subscribing, or using the Services you agree to these Terms of Service. If you do not agree, do not use the Services.
2. Definitions
- Platform / Services — the QualDashboard website, software and related services.
- Academy — a training business that subscribes to run a branded storefront and sell Courses.
- Learner — a person who registers through an Academy to buy and take Courses.
- Course — training content listed, sold and delivered by an Academy through the Platform.
- Platform Fee — our per-order fee described in clause 5.
3. Accounts & eligibility
- You must provide accurate information and keep your login credentials secure. You are responsible for activity under your account.
- Academies must be a business or sole trader operating lawfully in their territory. Account holders must be 18 or over.
- Learners register through an Academy’s storefront link and may access only their own Academy’s storefront and Courses.
4. Academy subscriptions
- Running a storefront requires an active paid subscription. Plans and prices are shown on our membership plans page and may include limits (e.g. number of Courses).
- Subscriptions are billed in advance on a recurring basis via our payment provider until cancelled. You can cancel at any time, effective at the end of the current billing period.
- Subscription fees are non-refundable for part-used periods unless required by law.
- Lapsed subscriptions: if a subscription ends or payment fails, your storefront and Course listings may be unpublished and new sales stopped. Learners already enrolled keep access to Courses they have purchased. Re-subscribing may restore your listings.
5. Selling & the platform fee
- Each Academy is the seller of its Courses to its Learners and contracts directly with them. QualDashboard provides the Platform that facilitates listing, checkout and delivery; it is not a party to the contract between an Academy and its Learner.
- For each Course order, QualDashboard charges a Platform Fee of £15 per order (applied to the order, not per Course). We may change the Platform Fee on reasonable notice.
- Academies are responsible for setting their own prices, descriptions, taxes and Course terms, and for the accuracy of their listings.
6. Payments & withdrawals
- Payments are processed by our third-party payment provider (Stripe). You agree to their terms where applicable.
- Funds from Course sales, less the Platform Fee and any applicable payment-processing or refund amounts, are made available to the selling Academy through the Platform’s withdrawal system, subject to a minimum withdrawal amount and a short availability hold.
- Academies are solely responsible for their own tax obligations (including VAT where applicable) on their Course sales. QualDashboard is responsible for tax on its own fees.
7. Learner purchases & refunds
- When a Learner buys a Course, the contract for that Course is between the Learner and the Academy. The Academy is responsible for delivering the Course and for Learner support.
- Refunds are set and handled by the selling Academy in line with the Academy’s own refund policy and applicable consumer law (including, where relevant, rights relating to digital content). QualDashboard may facilitate refunds at an Academy’s request but is not responsible for them.
- Where a refund is issued, the related Platform Fee and payment-processing costs may be non-refundable to the Academy.
8. Academy content & conduct
- Academies are responsible for all content they upload (Courses, lessons, quizzes, media, branding) and warrant that they own it or have the rights to use it and that it is lawful and accurate.
- Academies must comply with all laws applicable to their business, including consumer protection, advertising, distance-selling, and any sector or qualification rules relevant to their training.
- Academies grant QualDashboard a non-exclusive licence to host, store, display and transmit their content as needed to operate the Services.
9. Accreditation disclaimer
QualDashboard is a technology platform. It does not award, endorse, verify or guarantee any qualification, accreditation, certification or regulatory status (including, for example, VTCT or OFQUAL-regulated provision). Any such claims are made by, and are the sole responsibility of, the relevant Academy. Learners should satisfy themselves about an Academy’s credentials and a Course’s status before purchasing.
10. Intellectual property
- QualDashboard and its software, design and branding are owned by us or our licensors. You may not copy, resell or reverse-engineer the Platform.
- Academies retain ownership of their own Course content, subject to the licence in clause 8.
- Learners receive a personal, non-transferable licence to access the Courses they purchase for their own learning, and may not copy, share or redistribute Course content.
11. Acceptable use
You must not use the Services to: break the law; infringe others’ rights; upload malware or harmful code; attempt to bypass the Platform’s access controls or isolation between Academies; scrape or harvest data; send spam; or misrepresent your identity, business or qualifications. We may remove content or restrict accounts that breach these terms.
12. Data protection (processor terms)
This clause applies where QualDashboard processes personal data of an Academy’s Learners on the Academy’s behalf. For this data, the Academy is the controller and QualDashboard is the processor. Our handling of personal data is described in our Privacy Policy. In summary, QualDashboard will:
- process Learner personal data only on the Academy’s documented instructions and to provide the Services;
- ensure persons processing the data are bound by confidentiality;
- apply appropriate technical and organisational security measures;
- engage sub-processors (e.g. hosting and payment providers) under comparable obligations;
- assist the Academy, so far as reasonably practicable, with data-subject requests, security, breach notification and compliance; and
- on termination, delete or return Learner personal data, except where retention is required by law.
The Academy warrants that it has a lawful basis to collect and use its Learners’ data and to provide it to QualDashboard for processing.
13. Disclaimers & liability
- The Services are provided “as is” and “as available”. We do not warrant that they will be uninterrupted or error-free, and we may carry out maintenance and updates.
- We are not responsible for the Courses, conduct, claims or content of any Academy, or for any contract between an Academy and a Learner.
- Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud).
- Subject to the above, our total liability to you in connection with the Services in any 12-month period is limited to the greater of the fees you paid to QualDashboard in that period or £100, and we are not liable for indirect or consequential loss, or loss of profit, revenue, data or goodwill.
- You agree to indemnify QualDashboard against claims arising from your Courses, your content, or your breach of these terms.
14. Suspension & termination
- You may stop using the Services and close your account at any time.
- We may suspend or terminate access if you breach these terms, fail to pay, or where necessary to protect the Services, other users or comply with law.
- On termination, your right to use the Services ends. Provisions that by their nature should survive (e.g. fees owed, IP, liability, data-processing wind-down) will continue.
15. Changes to these terms
We may update these terms from time to time. If we make significant changes we will notify you via the website or by email. Continued use of the Services after changes take effect means you accept the updated terms.
16. Governing law & contact
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
